Divorces can be contested, or uncontested.

In cases of uncontested divorce (where the parties are able to agree on the terms of separation), the court process is streamlined. After filing initial documents, and assuring the Court that any children of the marriage have been reasonably provided for, the parties can ask the Judge to sign off on their Divorce. Where all goes smoothly, this is the most cost-effective way to proceed with Divorce.

Where parties are not able to agree on all issues, the Divorce will become a contested issue. The parties will have to complete a number of pre-requisites, an eventually proceed in front of a Judge, and eventually a trial. This process can be quite procedural and complex.
